Legal tips (common misconceptions)
Next-morning residual alcohol still counts
Drinking the night before then driving in the morning — if your BAC is still ≥20, it is drunk driving; ≥80, criminal. The body metabolises only ~0.10-0.15‰ per hour (varies widely), so 250 ml of baijiu needs 10-15 hours to fully clear. Do not bet on "I slept it off."
Liquor-filled chocolates, fermented rice wine, medicinal tinctures can register
Liquor-filled chocolates, fermented rice-wine soup, Huoxiang Zhengqi water, certain TCM tinctures and topical liniments — eaten in large amounts can push breath BAC above 20. If a checkpoint registers, request a re-test after 15-20 minutes or a confirmatory blood draw on the spot; blood is the legal benchmark.
Passive or coerced drinking does not exempt you
"They forced me to drink" is not a legal defence — you remain the responsible party for the decision to drive. If you were genuinely coerced, you can pursue civil or even criminal liability against the persons who pushed alcohol on you (Civil Code Art. 1165), but the dangerous-driving charge against you still stands.
Moving the car a few metres, or self-driving after the chauffeur leaves, still counts
"I only moved it 5 metres in the compound", "the chauffeur dropped me at the gate and I drove into the garage", "I was pushing it, not running it" — once the engine is running and the car moves on a road (including compound roads open to traffic), the dangerous-driving offense is complete. The 2023 guidance permits non-prosecution only for de minimis cases (low BAC + minimal distance + no accident + voluntary confession).
Commercial insurance refuses and mandatory insurance recovers — both are guaranteed
After a drunk-driving accident, commercial property, third-party liability, and driver-seat insurance all refuse to pay — this is a statutory exclusion (Insurance Law Art. 17 plus standard auto-insurance terms). Mandatory insurance (交强险) advances payment to victims for medical care and death, then recovers from you personally (Mandatory Insurance Regulation Art. 22). One accident can leave you owing hundreds of thousands of yuan.
An over-spec e-bike can legally count as a motor vehicle
Many assume an e-bike is exempt. What matters is whether it exceeds spec: if the kerb weight, top speed, or motor power breaks the limits in GB 17761-2018, it can be classified as an electric moped or motorcycle. Once it counts as a motor vehicle, drunk riding is prosecuted under the dangerous-driving offense just the same. Check for the 3C mark and proper e-bike registration before you buy.
Blood is the conviction benchmark; breath is only a screen
A breath test is a roadside screen and can read high or low. If you dispute the reading, you may request a blood test on the spot; police should send the sample within 2 hours and no later than 24 hours. The blood BAC is what the court relies on for conviction. Asking for a blood draw is a procedural right, not resisting enforcement.
Fleeing is the sentencing watershed — never run
Fleeing after an accident is the aggravating factor that jumps the traffic-accident felony from under 3 years to 3-7 years, and to 7-15 years if the flight causes a death (Criminal Law Art. 133). It also forfeits every mitigating lever — surrender, forgiveness, compensation. If you hit someone, stop, call the police, help the injured, and stay. That always beats running.
Drunk driving is more than jail — a long tail of collateral fallout
A single conviction leaves a lifelong criminal record. It blocks political vetting for party membership, civil service, public institutions, the military and police, the legal profession, and teaching licences; it can bar your children from military and police academies and classified posts; and it can trigger dismissal or industry bans. The detention may last a month or two, but the record follows you for life. That math beats saving one chauffeur fare.
